Alexandria DUI With BAC of .15 Results in No Jail Time

Alexandria DUI Attorney – Client charged with DUI with an elevated BAC of .15 and Reckless Driving avoided all jail time after a plea agreement was reached between defense counsel and prosecution.  In Virginia, a DUI with a BAC of .15 or more requires by statute that the defendant serve 5 days in jail.  After a series of negotiations between Justin Ervin and the prosecution, the two sides agreed to reduce the DUI to DUI with a BAC of .08 (which carries no mandatory jail time) and drop the Reckless Driving Charge.  Defendant was sentenced to probation, and had his license suspended pursuant to the Virginia statute, but he avoided any active jail time.
